By filling out the participation application form, the contestant enters the selection process for participants in the Valamar Storyteller project. Participation implies the stay of the participant in arranged Valamar properties with the costs covered by the organiser. In return, the participants cover the happenings in the property and the destination on their social network profiles as previously agreed with the organiser. The participants bear the expense of arriving at the destination themselves.

1. Organiser
The organiser of competition “The Valamar Storyteller Project” is Valamar Riviera d.d., with its seat in Croatia, Poreč, Stancija Kaligari 1, OIB: 36201212847 (further: Valamar).
Valamar has all rights and obligations that arise from this competition.

2. Who can participate in this competition?
The competition is open to physical persons - influencers, that act as independent contractors, aged 18 years or over, except employees of Valamar and their close relatives and anyone otherwise connected to the organisation or judging of the competition.
The influencer`s country of residence is irrelevant.
Valamar reserves the right to disqualify a participant during the application in the event of any illegal acts.

3. How can influencers participate in this competition?
By filling out the online application form, the influencers enter the selection process for participants.
No responsibility can be accepted for entries not received for whatever reason.
Valamar has the right to subsequently directly invite influencers to participate by filling in the online application form.
There is no entry fee and no purchase necessary to enter this competition.
By applying to participate in the competition, the participants automatically accept all the current official Terms and Conditions.

4. Purpose
The purpose of this competition is to find one or more social media influencers that will sign an agreement on the promotion of Valamar`s properties: (hotels and campsites). Promotion will take place through the elected influencer`s social networks/blogs and other social media channels according to this T&C.

5. Participant selection
Valamar’s jury consists of three members that choose influencers based on the overall impression:
application form and data that they can find directly on social media (e.g. quality of interaction on the social networks listed by content etc.)
The winners will be notified by email and their name and surname will be published on websites.
If the winner cannot be contacted within 14 days from the end of this competition, Valamar reserves the right to withdraw the decision and pick a replacement winner.

6. Valamar`s and the elected influencer`s obligations
Valamar would organise and bear the cost of a stay of the elected influencer in Valamar`s property during the preseason (until 30 June 2020) and postseason (from 1 September 2020). The exact period and date of arrival and stay shall be agreed through direct communication.
The elected influencers will take part in the predefined activities organised by the organiser and cover the happenings in the property and the destination on the influencer`s social network profiles as previously agreed with Valamar.
The elected influencers will sign a contract with Valamar, in which all activities will be defined.
The elected influencer`s statements should always reflect honest and truthful opinions and actual experiences.
All services should be online for at least 3 months after the stay in Valamar`s property has ended.
The elected influencer bears the travel expenses to the destination. The elected influencer will perform the services at its own expense and using its own resources and equipment.
The influencer will comply with all applicable state and local laws, regulations, administrative guidelines, orders and ordinances, including without limitation, all privacy and data security laws and the terms and conditions of all applicable third-party websites, platforms or applications, in rendering the services herein.
The influencer is solely responsible for its tax obligations.

7. Duration
This competition runs from 17th January to 31st March 2020.

8. The relationship between the parties
The influencer acknowledges and agrees that the influencer’s relationship with Valamar is that of an independent contractor and nothing in these Terms is intended to, or should be construed to, create a partnership, agency, joint venture or employment relationship. The influencer is not authorized to make any representation, contract or commitment on behalf of Valamar.

9. Personal Information, Privacy Policy
By applying to participate in the competition, the participants automatically acknowledge and accept that Valamar, as controller, will process their personal data required in the application form that the participant filled in.
Valamar guarantees the protection of personal data in accordance with the guidelines on the protection of personal data. Valamar will save the participants` personal data for 3 months after this competition ends, and the data of the elected influencer as a contractor in accordance with the applicable laws. The project participant has the right to request access to the collected personal data, to the correction of personal data, to cease participation in this competition and to erase the personal data at all times, and all other rights in accordance with the EU GDPR by contacting Valamar on e-mail dpo@valamar.com. While performing the services, the elected influencer acknowledges the following:

• Protect your privacy by keeping in mind that your posts are public.
• Don’t share personal or sensitive information about you or your family that you may not want to make available to the public.
• Do not include personal information about any third party that has not been voluntarily made available by them for you to share in your posts. This includes any information that could make it possible for someone to reasonably identify another person.

10. Intellectual Property Rights
The elected influencer grants Valamar the right to use Instagram posts, as well as other material that may be generated according to this cooperation. Valamar may use it for advertising and promotional purposes in marketing material, including but not limited to use in catalogues, magazines, websites, newsletters and social media such as Facebook, Instagram and Twitter. This usage right is not subject to any geographical restrictions and is valid for an indefinite period of time. Furthermore, the influencer agrees that Valamar is entitled in a fair manner to use the influencer’s name and image for PR purposes.
The influencer shall not use Valamar’s or a client’s copyrights, trademarks, trade names or other intellectual property in any way except to the limited extent as may be expressly agreed.

11. Confidentiality
The influencer may not disclose, use or take advantage of any confidential information, which the influencer may have obtained during the cooperation with Valamar. Violation of the obligations in this paragraph shall be considered a fundamental breach of contract and the influencer may be held liable for damages caused thereby.

12. Dispute resolution
In the event of a dispute between the organiser and the participants, the parties shall resolve all disputes amicably, and if this is not possible, disputes will be subject to the exclusive jurisdiction of the courts of Croatia and the jurisdiction will be determined according to the headquarters of Valamar.
The competition and these terms and conditions will be governed by Croatian law.

13. Final provisions
Valamar has the right, at its sole discretion and at any time, to change or modify these terms and conditions; such change shall be effective immediately upon posting to this webpage. Valamar also reserves the right to cancel the competition at its sole discretion and at any time.
